Those who are not citizens of Israel or immigrants under the Law of Return and are in Israel without a residence permit (staying illegally) will be deported from Israel as soon as possible unless they have voluntarily left before.
The removal from Israel of residents who stay in illegally will be under a deportation order issued by the Interior Minister. In addition, the border control officer in the Ministry of the Interior is authorized to order the detention of residents who are not following Israeli law to deport them from the state borders as written in the deportation order. To this end, the border control officer issues a custody order: an arrest warrant that stipulates that in order to ensure deportation, illegal residents must be held in a place of custody under the provisions of the law.
A detainee in custody that wants to be released can refer a reasoned and written release request to the Custody Review Tribunal through an attorney. A hearing will usually be scheduled to examine the release request in the presence of the parties involved and their representatives.
As the immediate removal of detainees from the Israeli borders is expected, upon submission of the request for release, a prompt hearing date on their case will be set. Alternatively, the Ministry of the Interior will submit its response to the release request immediately, after which the final decision will be given.
